I want to marry my fiancée from the Philippines and bring her back to the United States. What must I do?
There are two options.
One, you can legally marry in the Philippines. You next file a petition for a foreign relative (I-130) for your new wife. Once accepted, she applies for a CR1 spouse visa. When granted, she will receive her two-year green card, allowing her to come to the United States.
Two, you can submit an I-129 Petition for Alien Fiance. Once accepted, she applies for a K1 fiancé visa. When accepted, she will be able to go to the United States once and stay for 90 days. If you marry during those ninety days, she can apply for an “Adjustment of Status” and remain legally in the US while it is processed, which will result in a two-year green card. If you choose not to marry, she must return within 90 days.
Both of these procedures demand a variety of documentation, including verification of your ability to provide financial support, proof that you are both lawfully married, medicine and vaccine requirements, and so on. Both will include an in-person interview with your fiancé. The K1 process involves more processes, but it used to be faster to get someone into the United States. I am not sure if it is still true. A qualified immigration lawyer would know.
In both circumstances, within three months before the two-year green card expires, you file for an “elimination of conditions” to obtain a permanent green card (which is actually a ten-year green card that may be renewed easily). This necessitates giving proof of your ongoing partnership, such as tax papers, insurance, and banking records. This was, in my opinion, the worst phase, as it took two and a half years to process. We would receive various letters extending her two-year green card while things were processed, but it caused some travel issues. It also caused issues with her American driver’s license because they would only extend it to match the green card extension, so she had to reapply for it every year.
Despite their length and complexity, these procedures are considered “quick and easy” by American immigration standards. There are no quotas for these visas, so as long as you have a true legal relationship and complete the legal and financial conditions, your application should be approved.
